Abstract

The Indian Constitution protects minorities by combining individual equality with specific cultural and educational guarantees, primarily through Articles 29 and 30, supported by provisions like Articles 14, 15, 25–30, 350A, and 350B. Enforcement is hindered by issues regarding minority identification, institutional autonomy, government regulation, state aid, admission policies, and balancing minority rights with principles like secularism, merit, and national interest. The article analyzes key Supreme Court precedent—from Champakam Dorairajan and T.M.A. Pai to the 2024 Constitution Bench judgment in Aligarh Muslim University, which revisited the meaning of "established" under Article 30. The primary issue is inconsistent implementation rather than a lack of legal guarantees. The author advocates moving toward a rights-based framework that balances minority identity, autonomy, equality, and constitutional morality through clearer determination criteria, transparent regulation, and harmonious judicial doctrine. The study argues that the principal difficulty is not the absence of constitutional protection but the uncertainty and inconsistency surrounding its implementation. The constitutional balance must therefore move beyond a narrow institutional understanding of minority rights towards a rights-based framework that simultaneously protects minority identity, institutional autonomy, academic excellence, equality and constitutional morality. The study concludes by suggesting clearer criteria for minority determination, transparent regulatory standards, stronger institutional accountability, effective grievance mechanisms and a harmonised judicial doctrine.
